Terms of Service
The terms and conditions governing your use of Assurement.

These terms govern the use of Assurement's app (iOS and Android) and web platform. This English text is a translation; the Danish version is the binding version.
Creating an account and using the app and web platform is free. You pay only when you choose to generate a report (pay-per-report); there is no subscription.
§ 1 — Definitions and scope
1.1 "Assurement", "we", "us" means Assurement ApS, company reg. no. (CVR) 44 88 01 48. 1.2 "the Service" means Assurement's quality-assurance (KS) and static-documentation (DS 1140) software, delivered as a mobile app (iOS and Android) and a web platform, together with related content and documentation. 1.3 "User", "you" means anyone who creates an account or uses the Service. 1.4 "Report" means a generated, exportable or printable quality-assurance or DS 1140 documentation output that you obtain from the Service for payment. 1.5 "Consumer" means a natural person acting primarily outside their trade or profession. 1.6 "Business customer" means a user acting in the course of their trade who, at sign-up, has provided a CVR number and separately confirmed acting as a business. 1.7 A provision applies to all users unless stated otherwise.
§ 2 — Licence and right of use
2.1 Assurement grants you a non-exclusive, non-transferable, revocable right to access and use the Service. Account creation and general use of the app and web platform are free of charge. 2.2 You must not reverse-engineer, decompile, sublicense, resell, share accounts, scrape, or obtain unauthorised access, except where mandatory law permits.
§ 3 — Pre-contract information for report purchases
This section applies to consumers and concerns the purchase of a report. 3.1 Before you place a payment-bearing order for a report, we disclose clearly: the main characteristics of the report; the total price incl. VAT and all fees; the means of payment and delivery; the Service's functionality, compatibility and interoperability; and complaint access under § 3.3. 3.2 Order button. Immediately before ordering, the information is repeated in highlighted form and the order button is labelled "order with payment obligation" or an equivalent unambiguous phrase. 3.3 Complaint access. You may complain to the Mediation Team for Consumer Complaints and then the Consumer Complaints Board (Nævnenes Hus). EU consumers may also use the EU Online Dispute Resolution (ODR) platform. 3.4 Language. As the Service is marketed in Danish, the Danish text is the governing consumer version.
§ 4 — Free use, reports and payment
4.1 Free use. Creating an account and using the app and web platform — including preparing and storing quality-assurance documentation — is free of charge. 4.2 Pay-per-report. You pay only when you choose to generate or obtain a report. Each report is a separate, one-off purchase at the price shown and accepted before purchase. There is no subscription and no automatic renewal. 4.3 Price and VAT. To consumers, the price of a report is always shown first as the total price incl. VAT and all fees. 4.4 Payment channel and refunds. All report purchases and payments are made through our website (including via MobilePay); the app does not process payments.
§ 5 — Right of withdrawal
This section applies to consumers and concerns the purchase of a report. 5.1 As a consumer you generally have a 14-day right of withdrawal when you purchase a report by distance selling. 5.2 Consent to immediate delivery. A report is normally generated and made available immediately. If you want the report immediately, we ask for your express consent via a separate checkbox at purchase. 5.3 Each report purchase is a separate distance contract; consent is obtained afresh for each report. 5.4 Digital "Withdraw agreement" function. Where a right of withdrawal exists, you can exercise it through a prominent, always-available "Fortryd aftale" function on both the web and the app.
§ 6 — Ending use and account deletion
6.1 You may stop using the Service at any time. Because use is free and reports are one-off purchases, there is no subscription to cancel and no notice period. 6.2 You can delete your account and associated data at any time. 6.3 A purchased report remains subject to the right of withdrawal in § 5 until that right lapses.
§ 7 — Changes to these terms
7.1 Business customers. We may update the terms; continued use after the effective date constitutes acceptance. 7.2 Consumers. Material changes occur only under a valid change clause, with individual notice and a right to stop using the Service before the change takes effect.
§ 8 — Conformity and defects
8.1 Save for mandatory rights, the Service and reports are provided "as is". 8.2 Consumers. For a purchased report you have non-excludable remedies for non-conformity: bring into conformity, proportionate price reduction, or termination, with at least 2 years' liability. 8.3 KS/DS 1140 — tool, not advice. The platform is a digital aid and does not constitute professional engineering advice or a guarantee that the generated documentation meets DS 1140:2019 or BR18. Responsibility for quality control rests solely with the executing contractor.
§ 9 — Liability
§ 9a — Limitation of liability (business customers): 9a.1 Assurement's aggregate liability is capped at the greater of amounts paid in the 12 months before the claim, or DKK 1,000. 9a.2 We are not liable for indirect or consequential loss. 9a.3 Claims must be brought within 12 months. 9a.4 The limitations do not apply to intent, gross negligence, death or personal injury. § 9b — Liability towards consumers: 9b.1 The non-excludable statutory remedies apply. 9b.2 No monetary liability cap applies towards consumers. § 9c — Indemnity (business customers): 9c.1 The business customer indemnifies Assurement against third-party claims arising from the customer's content or breach. 9c.2 Assurement indemnifies the business customer against IP infringement claims.
§ 10 — Intellectual property and user content
10.1 Assurement owns all rights in the Service, software, DS 1140 logic, templates and trademarks. 10.2 You retain ownership of your uploaded content and of the reports generated from it. You grant Assurement a limited licence to host, process and display the content solely to deliver the Service. 10.3 Suggestions and feedback are assigned to Assurement so we can improve the Service. 10.4 Assurement may assign the agreement on a sale or restructuring.
§ 11 — Data processing and personal data
11.1 For personal data your business uploads, your business is the controller and Assurement is the processor. 11.2 Processing is governed by a separate data processing agreement. 11.3 Assurement does not use the customer's uploaded photos or documentation for anything other than delivering the Service. 11.4 You can delete your account and associated data both in the app and via the website. 11.5 Our privacy policy and cookie policy are provided separately.
§ 12 — Disputes and governing law
12.1 The agreement is governed by Danish law, excluding CISG. 12.2 Business customers: Venue is the Danish courts at Assurement's registered seat. 12.3 Consumers: You retain the mandatory consumer-protection rules and the courts of your country of residence.
§ 13 — Consumer protection
Nothing in these terms limits the mandatory rights you have as a consumer under Danish or EU law. If a term conflicts, it yields to the mandatory rules.
§ 14 — Miscellaneous and contact
14.1 Unlawful use, circumvention of security, scraping or uploading unlawful content is prohibited. 14.2 The Service is provided on a reasonable-efforts basis; planned maintenance may occur. 14.3 We may suspend or terminate access for breach.
